Walking Tours - Terms and Conditions Cornish Explorer LTD

All bookings and ticket purchases for Cornish Explorer LTD walking tours made through www.cornishexplorer.co.uk are subject to the terms and conditions set out below. We encourage you to read the following terms and conditions carefully. It is under these Terms and Conditions that bookings are made and accepted by Cornish Explorer LTD. When a Customer makes a booking it will be deemed they have accepted the Terms & Conditions on behalf of all individuals included in the booking and consents to these Terms & Conditions. No alterations or variations to these Terms & Conditions will be accepted unless agreed in writing by Cornish Explorer LTD.

DEFINITIONS

  • “We” and “us” and “Company” and “Cornish Explorer” means Cornish Explorer LTD, registered in England and Wales number 14302024, or any appointed representative thereof. “Our” and “ours” are implied by extension.
  • “You” or “Customer” means you or any other person for whom you are purchasing a ticket, or anyone acting on your behalf. “Your” and “yours” are implied by extension.
  • “Tour” means the event or events for which you are purchasing a ticket, as described on this website, at the time or times and on the date or dates you select via this website.
  • “Ticket” means the rights of attendance and admission to the tour, in the form of an email delivered electronically via this website.
  • “Guide” means our appointed representative who is conducting and delivering the tour.
  • “Seller” means our appointed representative who is responsible for checking tickets.

PRICES

The prices appearing on the website are the current rates and can change with no prior notice. Once a Customer has booked a tour with Cornish Explorer, the Customer will not be required to pay any difference in the event of a price increase and Cornish Explorer LTD will not refund the balance of any price reduction. All prices are per person or per groups of up to 6 unless otherwise stated.

TICKETS

You must be 18 years old or older to purchase tickets via this website.

Tickets are sold in the form of an email which contains the details of your purchase, and which is delivered electronically via this website. Please note we do not send out physical tickets.

A request by you to purchase tickets using this website is an offer made subject to these terms and conditions. The offer is made when you click the “Proceed to Checkout” button on the “Booking” page of this website. Please check the details of your order carefully before clicking the “Proceed to Checkout” button, as we may not be able to rectify mistakes later. Acceptance by us of your offer shall be deemed to be effective when your payment has been cleared and we have confirmed your order by delivering your ticket electronically via email.

It is your responsibility to ensure that you provide a valid email address for an email account you have access to, and to ensure that any spam or junk mail filters do not prevent delivery of emails from kate@cornishexplorer.co.uk. If you have not received your ticket within a few minutes of purchasing, and have checked spam or junk mail folders, you should contact us; if payment has been received we will be able to resend your ticket.

Cornish Explorer LTD tickets must not be offered for sale or resale, or resold or used for any commercial purpose, including without limitation promotion of any supplier or any supplier’s products or services, without the Company’s prior written permission.

Ticket Validity & Gaining Admission to the Tour

Tour Guides wear uniform/badges displaying the Cornish Explorer logo.

Customers must bring their valid ticket(s) to the tour. The Tour Guide will have a list of people who are expected, but your ticket will be required to confirm payment, and also necessary in the event of last minute bookings and/or booking error. Your e-ticket entitles the named Customer to join the tour on the date specified. It cannot be used for another person, or for another day.

You may present your ticket to a tour guide in the form of a printed-out paper copy, or on the screen of an electronic device; if the latter, please ensure that your device is charged, and that the ticket has not been deleted from the device. (please note that some email applications automatically delete older emails.)

The tour will depart promptly at the scheduled departure time. You are advised to arrive at least fifteen minutes prior to this time, as the guide will not wait for you if you are late.

When you arrive, please present your ticket to the guide or a seller and if on the occasion a walking disclaimer has not been signed prior to the tour, you will be requested to read, acknowledge and sign before the tour begins. If a walking disclaimer has not been signed, you will not be allowed to attend and refunded as per our company policy.

During the Tour

All Customers acknowledge and agree that they participate in the tour at their own risk and would have previously read and signed the walking disclaimer.

When the tour moves from one location to the next, you should ensure that you pay attention to the instructions of the guide. The guide will make reasonable efforts to ensure that you do not lose the tour, but this is ultimately your responsibility.

All Customers must obey the directions and instructions of the Company’s guide, must not disturb other Customers or interfere with the Company guide’s ability to conduct the tour in a safe manner.

Customers are not to record in any manner or take notes throughout the duration of the tour, as the information imparted on the tour is the intellectual property of the Company.

Customers must comply with the following rules:

  • You must follow any safety warnings and/or instructions displayed or given to you by a member of staff before and during the tour. Ask a member of staff if you are unclear.
  • Personal property belonging to you is at all times your sole responsibility.
  • You must carry adequate hydration with you at all times.
  • You must not participate if you are under the influence of alcohol or non-prescription drugs.
  • You must at all times keep with your group and follow your guide’s instructions. You must never stray away from the group.
  • You must wear appropriate clothing in accordance with our guidance on our booking FAQ pages, any questions should be directed to staff before booking.

We reserve the right to refuse attendance and admission to the tour in reasonable circumstances or to terminate a customer’s involvement in the tour (without refund) if we deem his or her or their conduct to be offensive or a nuisance to other Customers. Cornish Explorer also reserves the right to refuse access to participate on a particular tour should circumstances be deemed to compromise the tour safety.

Arriving Late for a Tour

The tour will start at the time stated. The guide will not be able to answer their phone to give you directions once the tour has started. We do not offer refunds to people who miss the tour because they are late. Cornwall’s roads do get busy in high-season and has the potential to be subject to local traffic management alterations including but not limited to road closures, diversions, congested traffic etc. You are responsible for making allowance for any potential delays to your arrival.

Photography, Video and Audio Recording

We sometimes take photos and videos of our tours. These may be used for marketing purposes on our website, social media, newsletters and through third party advertisers. On such occasions we will ask again for your verbal consent at the start of the tour and will not take your photo or video if your consent is not given.

Photographs remain copyright to the Company and may only be used or reproduced by Customers for private or domestic purposes and must not be used for any commercial purpose, including promotion of any supplier or any supplier’s products or services, without the Company’s prior written permission.

If you are keen to use video on the tour, ensure you ask the guide first. On the whole, videoing the locations is fine, but please do not video the guide unless permission has been granted.

Photographs you take during the tour may only be used for personal, private, non-commercial purposes and must not be made publicly available (e.g. on social media), except where the photographs do not depict the guide, sellers or other members of the tour group, or permission is otherwise granted.

Modifications or Cancellation by Customers

As you are purchasing tickets for an event, we are not obliged to provide a refund in the event of cancellation on your part.

We will however refund any cancellation made 3 weeks before the time of the tour. This refund will be for the full price of the booking. We will not offer partial refunds.

It is not possible to make changes to existing bookings, unless Cornish Explorer receives notification 48 hours in advance, in writing, to kate@cornishexplorer.co.uk.

Otherwise, if you are unable to attend, we can transfer your tickets to a tour at a different time or date (subject to availability), or to another person, provided the transfer is for the equal number of attendees and confirmation in writing by Cornish Explorer LTD.

Modifications or Cancellation by Cornish Explorer LTD

Cornish Explorer undertakes not to cancel any tour within two weeks of the tour start date unless forced to do so by circumstances beyond its reasonable control.

In the event that we have to cancel a tour, before the tour start date for any reason other than force majeure, the customer shall receive a full refund of the monies paid to us but will not be entitled to any further sum by way of compensation, damages or otherwise arising from said cancellation.

In the event that we have to cancel a tour before, on, or after the tour start date due to force majeure, the customer will not receive any refund nor will they be entitled to any sum by way of compensation, damages or otherwise arising from said cancellation.

Force Majeure: Where war or terrorist activities, threatened or actual, civil unrest, industrial action, threatened or actual, weather conditions, fire, flood, drought, epidemics and pandemics, airport regulations or closures, unforeseen alterations to public transport schedules and rescheduling of aircraft or any other event outside the control of Cornish Explorer either delays or extends the tour, forces a cancellation or compels a change in prior arrangements, the Business cannot accept liability for any resulting loss, damage or expense to the customer.

Loss, Damage, Injury, Death

We cannot be held responsible for the loss of or damage to your personal property during the tour. Please keep your belongings with you at all times.

We shall not be responsible for any death or personal injury during the tour, howsoever caused, save were caused by our negligence or for any other matter for which it would be illegal for us to limit, or attempt to limit, our liability. For example, when the guide crosses a road it does not necessarily mean it is safe for you to do so and you should take all precautions that you normally would.

In the event that a tour has to be cancelled or abandoned part way through, we will not be liable for any accommodation, travel or other costs you incur.

In no circumstance shall we be liable for any indirect, special or consequential loss, including but not limited to loss of profit, data, revenue, business opportunity, anticipated savings, goodwill or reputation whether in contract, tort or otherwise arising out of or in connection with this agreement or purchases made through this website, save where such liability cannot be excluded by law.

In any case, our liability to you is limited to the purchase price of the tickets you have purchased.

Third Party Websites

We may provide links on our website to the websites of other companies or organisations, whether affiliated with us or not. We cannot accept any liability for tickets you purchase from companies or organisations to whose website we have provided a link on our website.

Privacy

Your personal information will be held on secure servers. We will use your personal information only for the purposes of providing the tour to you, and will not divulge it to any third party, save as required to our contracted service providers for the necessary operation of this website (e.g. payment processing). We will not store your payment card details.

General

Section headings are for reference and ease of reading only and do not form part of these terms and conditions.

If any provision of any of these terms and conditions is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of the terms and conditions shall not be affected.

We may modify any of these terms and conditions at any time by providing the modified terms each time you make a purchase, therefore you should check these terms each time you make a purchase.

All disclaimers, indemnities and exclusions in these terms and conditions shall survive termination of the agreement between you and us for any reason.

English Law governs these terms and conditions and each party submits to the exclusive jurisdiction of the English courts.

Neither party shall be liable to the other to the extent that any liability relates to an event over which that party has no control.

The parties shall not assign this agreement to any other party without the other’s consent.

No part of this agreement is enforceable by anyone who is not a party to it, pursuant to the Contracts (Rights of Third Parties) Act 1999.

These terms do not affect your statutory rights as a consumer.

Refunds

If you are not happy with the tour and would like to request a refund, please state your reasons clearly in an email to kate@cornishexplorer.co.uk. This does not include Customers who failed to turn up for their tour at the designated time or bad weather.

Membership Terms & Conditions | Cornish Explorer LTD

These terms and conditions outline the rules and regulations for using the Cornish Explorer Ltd online paid Membership. By signing up for the Membership, you agree to the terms and conditions set out below. If you do not agree to them, please do not register for the Membership.

Membership Details

a) The Membership is only available to those who register and pay for it.

b) In order to register for the Membership, the user must provide accurate and truthful information when filling out the registration forms.

c) Memberships are personal to the registered user and cannot be transferred to others.

d) Cornish Explorer Ltd reserves the right to refuse membership to anyone without providing a reason. 

Payment and Renewal

a) The Membership fee will be agreed at the time of purchase and payment must be made before access to the Membership is granted.

b) All transactions are processed in GBP. Cornish Explorer Ltd is not responsible for any exchange rate variation or bank fees that may be incurred by the user when making payment.

c) Memberships are valid from the time of purchase for the duration specified on the Membership plan and will automatically renew at the end of the Membership period unless the user chooses to cancel the Membership.

d) Cornish Explorer Ltd reserves the right to revise the Membership fee from time to time at its discretion and without prior notice.

Access and Use of Online Content

a) Members will be granted access to the online content while their Membership is live.

b) Users may view and print content made available to them by Cornish Explorer Ltd during their Membership.

c) Users must not copy, reproduce, distribute or share any content accessed through their Membership without the express written permission of Cornish Explorer Ltd.

d) Users must not use any content accessed through their Membership for any commercial or illegal purpose.

e) Cornish Explorer Ltd reserves the right to remove any content of the site without notice for any reason whatsoever.

Termination and Cancellation

a) Cornish Explorer Ltd reserves the right to terminate Membership of any user if they breach the terms and conditions.

b) Users can cancel their Membership at any time by emailing Cornish Explorer Ltd.

c) There will be no refunds for Membership fees once paid except as required by law.

Intellectual Property

a) All intellectual property rights in the content made available through the Membership remain the property of Cornish Explorer Ltd and are protected by copyright and other intellectual property laws.

b) Users must not reproduce, resell or distribute any of the content accessed through their Membership.

Limitation of Liability

a) Cornish Explorer Ltd takes no responsibility for the accuracy or completeness of information provided through the Membership.

b) Users acknowledge that they access the Membership at their own risk.

c) Cornish Explorer Ltd will not be liable for any loss or damage arising from the use of the Membership or any content accessed through it.

d) Cornish Explorer Ltd will not be liable for any loss or damage resulting from any interruption to the Membership, including but not limited to technical failures or server downtime.

e) Cornish Explorer Ltd will not be liable for any loss or damage resulting from any third-party activities or content.

Governing Law and Jurisdiction

a) These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales.

b) Any disputes arising out of or related to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

By registering for the Membership, you acknowledge that you have read and agree to be bound by these terms and conditions.

Digital Downloading Terms & Conditions | Cornish Explorer LTD

This Agreement governs the terms by which purchasers of Cornish Explorer LTD products obtain the right to use the digital content of Cornish Explorer  through the website located at www.cornishexplorer.co.uk (the “Site”). By downloading Content purchased from this site, you accept these Terms, and agree to be bound by its provisions. If you do not accept or agree with these terms, do not purchase download-only products. This Digital Downloading Terms of Use is in addition to thePrivacy Policy, General Terms and Conditions, and our Store Policiesapplicableto the Site and to all persons downloading content from the Site. In the event of any inconsistency between these Terms and the Site Terms of Service or any other Site policies (all of which are incorporated into this Agreement by reference), these Terms shall govern. In this Agreement: (i) “you” means the person downloading the content, (ii) “Cornish Explorer” or “we” or “us” means Cornish Explorer LTD, operator of the Site; and (iii) “Content” means any digital media or other material that you are downloading from the Site after purchase.

Downloading Terms

We hereby grant to you a perpetual, non-exclusive, non-transferable, worldwide licence to use the Content for the Permitted Uses only (as defined below). All rights in and to the Content, including, without limitation, all copyright and other intellectual property rights relating to the Content, are retained by Cornish Explorer or Kate Passmore, as is applicable.

Permitted Uses

(a) You may only use the Content for personal use only on your personal devices only. For clarity, you may not use the Content in products for resale, licence, or any other distribution. For example, you are not permitted to modify the Content via editing it with visual manipulation software, print it in any form, and sell it to others for consumption, reproduction or re-sale. Any use of the Content that is not a Permitted Use is an infringement of copyright.

(b) Restrictions. You are permitted to use the Content for personal use only, although you may transfer files among your personal devices such as phone, tablet, laptop, or desktop computer. You may install and use the Content in only one location at a time for each file, although there is no time limit on the duration you can use it for. You may physically transfer the Content from one location to another i.e., distributing it among your personal devices. If you require the Content to be in more than one location or accessible by more than one person, you must download the Content from the Site for each such use or individual. You may make only one (1) copy of the Content solely for back-up purposes.

(c) Any additional permitted uses must be approved in writing by Cornish Explorer.

Standard License Prohibitions

(a) Prohibited Uses. You may not do anything with the Content that is not expressly permitted in the preceding section. For greater certainty, the following are “Prohibited Uses” and you may not, either individually or in connection with others:

  • use the Content in any form, format, or applications intended for resale, licence, or other distribution, whether online or not, regardless of profit or revenue;
  • use or display the Content on websites or other venues designed to induce or involving the sale, licence, or other;
  • use the Content in books, magazines, newspapers, or any other publication, regardless of whether the final product is offered for sale, resale, licence, or other form of distribution;
  • incorporate the Content in any product that results in a redistribution or re-use of the Content or is otherwise made available in a manner such that a person can extract or access or reproduce the Content as an electronic file;
  • use the Content in a fashion that is considered by Cornish Explorer (acting reasonably) as or under applicable law is considered obscene, immoral, infringing, defamatory or libellous in nature, or that would be reasonably likely to bring any person or property reflected in the Content into disrepute;
  • remove any notice of copyright, trade-mark or other proprietary right from any place where it is on or embedded in the Content;
  • sub-license, re-sell, rent, lend, assign, gift or otherwise transfer or distribute the Content or the rights granted under this Agreement;
  • install and use the Content in more than one location at a time or post a copy of the Content on a network server or web server for use by other users;
  • use or display the Content in an electronic format that enables it to be downloaded or distributed via mobile devices or shared in any peer-to-peer or similar file sharing arrangement.

Terms of Agreement

(a) This Agreement is effective until it is terminated. You can terminate this Agreement by destroying the Content, along with any copies or archives of it or accompanying materials (if applicable), and ceasing to use the Content for any purpose. The Agreement also terminates without notice from Cornish Explorer if at any time you fail to comply with any of its terms. Upon termination, you must immediately (i) cease using the Content and for any purpose; (ii) destroy or delete all copies and archives of the Content or accompanying materials; and (iii) if requested, confirm to Cornish Explorer in writing that you have complied with these requirements.

(b) Cornish Explorer reserves the right to elect at a later date to revoke or amend the licence granted by this Agreement and replace the Content with an alternative for any reason. Upon notice, sent to the address or contact information provided by you, or such other address as you may advise us in writing to use, from time to time, of such replacement, the licence for the replaced Content immediately terminates for any products that do not already exist, and this licence automatically applies to the replacement Content. You agree not to use the replaced Content for future products and to take all reasonable steps to discontinue use of the replaced Content in products that already exist.

(c) Upon notice from Cornish Explorer, or upon your knowledge that any Content is subject to a threatened, potential or actual claim of infringement of another’s right for which Cornish Explorer may be liable, you must immediately and at your own expense (i) stop using the Content; (ii) delete or remove the Content from your devices, computer systems and storage (electronic or physical). Cornish Explorer shall provide you with replacement Content (which shall be determined by Cornish Explorer in its reasonable commercial judgement) free of charge, but subject to the other terms and conditions of this Agreement.

Cornish Explorer Representations and Warranties

(a) While we have made reasonable efforts to provide correct information in the Content, Cornish Explorer does not warrant the accuracy of such information.

(b) The Content is provided “AS IS ” without representation, warranty or condition of any kind, either express or implied, including, but not limited to to the implied representations, warranties or conditions of merchantability, or fitness for a particular purpose. Cornish Explorer does not represent or warrant that the content will meet your requirements or that its use will be uninterrupted or error free. The entire risk as to the quality and performance of the content is with you. Should the content prove defective, you (and not Cornish Explorer) assume the entire risk and cost of all necessary corrections.

General Provisions

(a) You specifically agree and acknowledge that you have, in addition to the terms of this Agreement, reviewed the Terms of Service and any other policies or agreements which may be incorporated by reference therein, and to the extent of their incorporation in this Agreement you agree to be bound by them.

(b) Cornish Explorer’s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right.

(c) This Agreement is personal to you and is not assignable by you without the prior written consent of Cornish Explorer.

Acknowledgement

By purchasing a download from Cornish explorer you acknowledge that you have read this agreement and understand its contents. In consideration of Cornish Explorer agreeing to provide the content, you agree to be bound by the terms and conditions of this agreement. You further agree that this is the complete and exclusive statement of the agreement between you and us, which supersedes any proposal or prior agreement, oral or written, and any other communication between you and Cornish Explorer relating to the subject of this agreement.
